I co-mod one one of the Sussex Freecycle sites and we have had a request from a member for a 10.3 install CD. I am not at all up to speed on Mac OS but a quick Google suggested that a copy of the OS was around $130 (US) and so probably not something given away lightly. I was wondering if loaning someone your CD/DVD breached any Mac licence agreement - presumably there is some kind of registration process. I want to be sure the poster to Freecycle was not breaching any Mac rules on its software.

Comments and pointers welcomed, please.

It would indeed invalidate Apple's terms of service. Although Apple do not police their OS the way Microsoft do. You could quite happily use the same installation disk on many machines & I have never heard of Apple pursuing someone for doing that, but yes you would be breaking the law!

This is a grey area as far as I am concerned. Apple supply copies of the OS with each machine so if you were putting the same version of OS X as the machine was supplied with then can't see its a problem. Technically it is but I doubt Apple would bat an eyelid over it. If you ar putting a higher version than the Mac was supplied with then it would be agaunst the EULA for the OS.

The registration is different to that in Windows. for a start there is no registration code/serial number to type in. I believe from OS X 10.4 that info regarding what machine it is installed on is sent back to Apple, bit "no personal info" is sent.

If I remember correctly 10.3 comes on 2 CD's and was the last OS to be supplied on this media. You should be able to get a cheap copy (legit that is) off Ebay. Might be worth looking up a local Mac User Group as they might be able to lend a recovery disk for the Mac in question.you can ry the Kent and East sussex group at.....

www.kesmug.co.uk

If the Mac is a G3 iMac or any G4/G5 laptop/desktop and has a DVD drive I'd buy a copy of 10.4 as they should run this OK.

I got this straight from the EULA :

"2. Permitted License Uses and Restrictions.
A. Single Use. This License allows you to install, use and run one (1) copy of the Apple Software on a single Apple-labeled computer at a time. You agree not to install, use or run the Apple Software on any non-Apple-labeled computer, or to enable others to do so. This License does not allow the Apple Software to exist on more than one computer at a time, and you may not make the Apple Software available over a network where it could be used by multiple computers at the same time."

Should clarify the situation

Do you already own OS X 10.3? If so, you can reinstall it from any disc you like - by all means borrow one. If not, you're breaking the law, though there's no registration process like there is with Windows, so Apple won't find out.

Thanks for the responses folks, we are keen to keep the Freecycle following the spirit of the rules at least and what I wanted to avoid was someone saying we shouldn't have done this. If I have followed this correctly basically the position is that the Freecycler who wants this is really in breach of the ender user agreement; the CD should be really used to reinstall the same OS and not to upgrade his system, but in any event there is unlikely to be any retribution.

So a check back with the poster is probably the order of the day.

I can believe how complicated MS make it to register, don't use it myself (except occasionally as a virtual PC) but did a reinstall for a friend who was not PC savvy and spent a lot of time pushing phone button on some automated system. 'Oribble!!

Thanks again, will also pass your comments to the other moderators for their info, so very helpful
