I cleared cmos when i got home from work and it has made no differance at all. Now on this board it has dual bios. could it be that it has gone into say bios bank 2 (if there is one) and this one cant be overclocked for whatever reason?

It may be possible. I'd check your mobo manual.

I alway use @ BIOS to do updates, never had any problems, using the F12 BIOS on the same board rev2 version.
Have you tried loading F6 Optimize Defaults, if this don't work then try clearing cmos again and then use @ BIOS to get F11 or F12 bios again.
When you update the bios it does save a copy I belive, not sure where though, can't remember.
Their is a warning on Gigabyte BIOS page which tells you always to load optimze bios defaulfts after updating bios, but their are others who have suffered the same problem as you, just google for GA P35 DS3R bios problems.
DS3R: E8200: 4gb Memory:8800GTS-640mb.
