This was a brilliant article both in the writing and content. It set out and explained much more than most of us could have imagined. My opinion is that the EULA's are in fact illegal in that they infringe the Human Rights Act. I feel that when I, as a customer or consumer, pay a premium price for goods then those goods become my property and I have the right to use or abuse same in any way I wish. Also the fact is that Pirates or criminals have been involved in counterfeiting for hubdreds of years without making a dent in company profits or indeed putting them out of business. After all Bill Gates has made billions despite the piracy which shows his software is vastly overpriced anyway. Not only that but most large companies can claim tax relief for any so called losses so considering all the four main music distributers are in profit I rest my case! Is it not ironic that EMI were able to give Robbie Williams £80m before he even made an album? It shows that both American and European Governments are in league with big business - corruption on a global stage. The majority of people who avail of illegal goods are in fact those on low incomes who are the victims of high price rip-off Britain.

I apoligise but didn't realize it was a rant. I was merely saying how much I liked the article and giving my tuppence worth. To me a rant is when you lose your cool whereas I thought I was giving a lucid comment. Feel free to move it to the rants category.

Spot on Docarooney.
I have just fallen foul of the EULA Spectre or at least I think I have by proxy with Valve, steam, sierra, Half life 2 (or whatever they call themselves) Quick Explanation...I don't play games very often but I bought HL2 second hand from ebay (stop tutting) and when I tried to run it, I was told after reams of splurge to set up a Steam account so I dutifully put in all my details, sock size, password etc and was told that the key belonged to another account which (after long story short) was invalid because the prior owner had cheated in a game (unrelated to Half life 2).
That is tantamount to buying a second hand car and not being able to drive it because the previous owner was banned due to getting speeding tickets??? Now stop me if I am wrong but there is NO reference on the disc or packaging that says 'NOT FOR RESALE' or the statement that the 'account is non transferrable' in big bold or indeed microscript as is the norm these days.
I have spent almost a week of precious computer time to end up at the point where I will have to 'buy a New game' as quoted by the polite Steam staff. No thanks!

Far too many such things about Steam, the games and the support - something about the mindset on the Forums makes a monkey of me too (and any user with dial-up complaints). Basically the mods' word is law, and you don't get to learn the rules (I posted topic [on Music forum here] about it with the excuse of an appropriate lyric). Trouble is it's achievements overshadow sacrifices (though they aren't any more valid) and there's no choice if you want the software.

Was impressed with the article as well, don't think anyone else has publicly covered this in depth. Okay, EULAs now available on the websites, but some of the conditions are something else...

Sorry to hear about your woes with your ebay purchase.

However, it's important to point out that when buying an item with intellectual property content, what you are paying for is the right to use that intellectual property for personal use.

The media that the intellectual property is stored on, is just a delivery method to get the product to you, but it isn't what you're paying for.

I understand and agree that you have been wronged, but the party that wronged you is the ebayer who sold you the item, and not the software distributor/manufacturer.

Since the ebay seller registered it to themself, they have benefited fully from what the original payment was providing, leaving nothing for anyone else.

In many cases, particularly computer software, once intellectual property is registered, the physical media on which it is stored, is worthless to anybody else appart from the registrant.

But I'm sure you know all this already!

The only thing I can advise is that if buying intellectual property through a source like E bay, only bid on auctions where the seller says EXPLICITLY that the item they are selling is GENUINE and UNREGISTERED. Most sellers who have genuine unregistered stuff will make a big deal of this point, so look out for statements like: ' still sealed in original packing and never even opened'.

If the auction looks thin on detail, you are correct to be more suspicious about what they fail to say, rather than what they do say.

If in doubt, ask them questions, and don't feel pressured into bidding if they don't come back to you in time - a bargain that doesn't do the job you bought it for, is no bargain at all - just wasted money!

Finally, just to remind you, as I'm sure you are aware, auction site written policies may seem to offer security and the promise of successful conflict resolution, but many, many people find that they fail to deliver in practice...

Thanks for the Wise words cocorico. Let the buyer beware and all that, It's still not nice to get stung even if the wasp has registered it's intellectual sting rights

I am sure that most people have one eye on resale tho when they buy a 'relatively' expensive item? Let's hope they don't sell cars on a subscription basis eh!

Right I'm off to ebay to get an unopened, still in the box, unregistered second hand? copy, as I hear it's worth it......(when will I ever learn)....
